FitShark Terms of Use

Welcome to the website and apps of FitShark ("FitShark Sites"). "FitShark Sites" includes fitshark.site, the FitShark App, and other sites where these terms are posted. FitShark and any entities affiliated, controlled by, or under common control with FitShark are collectively referred to as "we," "us," or "our."

Special terms may apply to certain services on FitShark Sites, such as subscription services, contests, or other activities. Such terms are posted with the applicable service and, in case of conflict, take precedence over these Terms. These Terms of Use (“Terms”) govern your use of FitShark Services and your relationship with FitShark. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Disclaimer

Before starting any exercise program through FitShark, consult your physician to ensure the program is appropriate for you.

Your use of the Service and participation in workouts or programs is at your sole risk. Not all exercises are suitable for everyone — consider factors like flexibility, strength, stamina, and overall health. Exercise can be inherently dangerous and may result in personal injury. FitShark disclaims all liability for injury from use of our programs. Information provided is for general reference and not intended to diagnose, treat, or prevent any medical condition.

Account Registration

You become a registered user and create an account ("Account") by providing a personal email or using single sign-on (e.g., Facebook).

Your Account is for personal, non-commercial use only. Each user may create one Account. You must wear proper exercise clothing when participating in workouts. FitShark grants a limited, non-exclusive, non-transferable license to use the Service application for private use only. You may not sell, share, or transfer your Account.

Application Use

Downloaded apps may only be used to access FitShark Services. FitShark may automatically update the app or system requirements. Updates or new versions are at FitShark’s discretion and are not guaranteed. FitShark may suspend, terminate, or limit Accounts for violations of Terms or suspected misuse. Termination may result in loss of content or access, with no obligation for compensation.

Responsibility

You are solely responsible for your use of the Service and account security. Do not share passwords or access others’ Accounts. You are responsible for all activity on your Account.

1. Use of Content

Content from FitShark Sites may not be used, reproduced, or distributed except as allowed by the Service. Downloaded content may be used once on a single device for personal use, with copyright notices intact, unmodified, and without implying association with FitShark. Automated or commercial use is prohibited.

2. Copyright & User Content

You may interact with wellness coaches or other users and submit content ("User Content"). FitShark does not monitor User Content but may remove content violating Terms. You retain ownership of User Content but grant FitShark a worldwide, non-exclusive, royalty-free license to use, adapt, and share it for Service purposes.

FitShark respects intellectual property rights and may terminate repeat infringers. Reports of copyright infringement can be sent to hello@runtimex.tech.

4. Public Forums & Communication

You are responsible for content you post in public forums. You may not post content that:

• Encourages illegal activity or includes illegal content (child pornography, harassment, fraud, etc.)
• Is commercial, promotional, or solicits others
• Is irrelevant, disruptive, antisocial, or abusive (spam, trolling, etc.)

5. Sales Policy

All digital products (ebooks, videos, downloads) are licensed to a single user. Sharing or transferring purchases is prohibited. Transactions use secure gateways (SSL encryption). Digital purchases are non-refundable. Contact hello@runtimex.tech for purchase issues.

10. Liability

FitShark is not liable for personal injury, death, or damages arising from use of the Service. Maximum liability is limited to the fees paid by the user. You agree to indemnify FitShark for claims arising from your use of the Service.

13. Disputes & Governing Law

These Terms are governed by the laws of the United States.
